1. About these terms
These terms apply when you access or use the Against The Grain website, including account features, third-party sign-in, online ordering, booking tools, product pages, events pages, and any other website features we make available.
By using the website, you agree to follow these terms. Separate sale terms and booking terms also apply when you place an order, make a booking, or use a transaction-specific service.
Nothing in these terms affects your statutory rights.
2. Who we are
The website is operated by Against The Grain, 25 Batchen Street, Elgin, IV30 1BH.
You can contact us at [email protected].
3. Eligibility and age-restricted services
You may browse general website content, but you must be at least 18 years old to create an account, use account features connected with alcohol purchases, place an alcohol order, or collect alcohol.
We operate age verification and Challenge 25 checks where required. We may refuse or cancel access to age-restricted services where we cannot verify eligibility, where details are inaccurate, or where licensing requirements mean we must refuse service.
4. Accounts and sign-in
If you create an account or use third-party sign-in, you must provide accurate information and keep your account secure.
You are responsible for activity on your account unless caused by our failure to take reasonable care.
We may suspend or restrict account access where we reasonably believe the account has been misused, used fraudulently, used unlawfully, or used in a way that harms the website, other users, or our business.
5. Third-party sign-in and external services
We may let you sign in with a third-party account, for example Google, Apple, or Facebook. Third-party sign-in is provided by the relevant provider and your use of that account is also subject to that provider's own terms and privacy notices.
We only request third-party account information needed to identify you, help you sign in, and operate customer account features. More detail about how we use personal data is set out in our Privacy Policy.
The website may link to third-party services such as payment providers, social media sites, map providers, or external information resources. We are not responsible for third-party websites or services.
6. Acceptable use
You must not misuse the website. This includes attempting to bypass security controls, interfere with the website, introduce malware, scrape or harvest data without permission, impersonate another person, submit false information, or use the website for unlawful purposes.
You must not use the website in a way that could damage our reputation, infringe another person's rights, or prevent other users from using the website normally.
7. Website content and availability
We aim to keep website content accurate and available, but we may update, remove, suspend, or change content and features without notice.
Product information, prices, stock levels, event information, opening hours, and booking availability can change. We may correct errors or omissions where needed.
The website is mainly intended for personal, consumer use. You may not copy, reproduce, distribute, or exploit website content for commercial purposes except as permitted by law or with our permission.
8. Orders, bookings, and venue services
Orders are subject to our Terms and Conditions of Sale. Bookings are subject to our Booking Terms and Conditions.
If there is any conflict between these website terms and transaction-specific sale or booking terms, the transaction-specific terms apply to that order or booking.
Venue access, alcohol service, collection, and event participation remain subject to licensing law, venue policy, and staff discretion where refusal or restriction is required or reasonable.
9. Privacy and cookies
Our Privacy Policy explains how we collect, use, store, and protect personal data.
We use cookies and similar technologies only where needed to run the website, support checkout, maintain account sessions, and protect the service, unless we tell you otherwise and obtain any consent required by law.
10. Liability
We do not exclude or limit liability where it would be unlawful to do so, including for fraud, fraudulent misrepresentation, negligence, or breach of your statutory rights.
Subject to the above, we are not responsible for losses that were not foreseeable, losses caused by your misuse of the website, or business losses arising from use of a website intended for consumer use.
11. Changes to these terms
We may update these terms from time to time. The latest version will be published on this page with the updated date.
If a change is material and affects account users, orders, bookings, or other important rights, we will take reasonable steps to make the change clear.
12. Governing law
These terms are governed by the laws of Scotland.
If you are a consumer elsewhere in the UK, any mandatory consumer rights that apply where you live are not affected.
1. Licensing and Service Operation
Against The Grain operates this service in strict accordance with the Licensing (Scotland) Act 2005 and The Moray Council Licensing Board’s Policies and Objectives.
Order Placing: Orders may be submitted online at any time, but alcohol orders are only accepted, processed, and made available for collection during our licensed off-sales hours. No contract for the sale of alcohol is formed until we accept the order during licensed hours.
Collection Windows: Your order will be ready for collection from the specific time slot selected during the checkout process.
Uncollected Orders: Orders not collected within 7 days of the scheduled collection time will be cancelled and refunded, minus a £2.50 reasonable administration/payment-processing charge, which reflects costs we incur from our payment processor.
2. Age Verification & Collection Policy
Sale of alcohol to persons under 18 is a criminal offence.
Legal Age: Ordering is restricted to persons aged 18 or over.
Age Confirmation: Before payment, you must confirm that you are aged 18 or over. We record this confirmation with the order for licensing and compliance purposes.
Identity Check: Orders should ideally be collected by the person who placed the order. Third-party collection must be notified in advance, and the collector must satisfy all ID requirements.
Challenge 25: We operate a strict Challenge 25 policy. If you appear to be under the age of 25, please be prepared to show valid photographic identification. We can only accept a valid Passport, Full Photocard Driving License, or Access Moray Young Persons Card with PASS logo.
Refusal of Service: We reserve the right to refuse collection if valid ID is not provided or if the collector appears to be under the influence of alcohol.
3. Payment and Security
Data Handling: All payment transactions are handled directly by our secure processor, SumUp.
Data Storage: Against The Grain does not store or have access to your credit/debit card details. We store contact information as permitted under GDPR to facilitate your order.
4. Product Availability and Substitutions
We strive for 100% inventory accuracy, but craft beer stock can move quickly.
Substitutions: In the event of a technical error or stock shortage, we reserve the right to substitute items with products of a similar style and equal or greater value.
Speciality Items: For rare or limited-release speciality items, we will attempt to contact you via the details provided to discuss alternatives before applying any substitution. If we cannot reach you, or a suitable alternative is unavailable, a refund will be issued for the missing item.
5. Returns and Hygiene
Due to the perishable nature of our products and for health and safety reasons:
No Returns: We cannot accept returns or "change of mind" exchanges once the product has left our premises.
Product Issues: If a product appears defective, damaged, spoiled, or not as described, please contact us as soon as reasonably possible, ideally within 24 hours of collection, so we can investigate and arrange an appropriate resolution. This does not affect your statutory rights.
6. Pricing and VAT
All website prices include VAT at 20% and are for takeaway only. Prices for products to be consumed in our venue are clearly marked as such.
7. Responsible Drinking
Against The Grain promotes the responsible consumption of alcohol. Please enjoy our products in moderation. For more information, visit drinkaware.co.uk. To find out more about Challenge 25, please visit https://beerandpub.com/sbpa/challenge-25/
1. Booking Requests and Confirmation
Online table bookings are subject to availability and are confirmed only when the booking form has been submitted successfully and a booking reference has been issued.
Against The Grain may contact you using the email address or phone number supplied if we need to discuss your booking.
2. Arrival Time and Table Duration
Please arrive on time for your booking. Standard bookings are for the published booking duration shown in the booking flow unless we agree otherwise.
If you are running late, please contact us as soon as possible. We may release or amend tables where guests do not arrive within a reasonable time.
3. Party Size and Direct Bookings
Online bookings are available only up to the party size shown in the booking flow. Larger parties, same-day restrictions, private events, or unusual requests may need to be arranged directly with us.
Please provide accurate party size information so we can assign suitable table space.
4. Deposits and Event Days
Some dates or time slots may require a deposit to secure the booking. Where a deposit is required, this will be shown before submission.
Deposits are linked to the booking date and time selected and may be handled differently for special events.
5. Changes and Cancellations
You can manage eligible bookings using your booking reference and contact details where the booking flow allows it.
If you need to change or cancel a booking and cannot do so online, please contact us directly.
6. Licensing and Age Policy
Against The Grain operates in accordance with applicable licensing requirements. Guests may be asked for valid photographic identification where age verification is required.
We reserve the right to refuse service where required by licensing law or venue policy.
7. Conduct and Venue Policy
We reserve the right to refuse, amend, or cancel bookings where guest conduct, incomplete details, capacity limits, licensing requirements, or operational issues make this necessary.
Please tell us about accessibility needs, special seating requirements, or other important requests as early as possible so we can do our best to accommodate them.
